PLEASE NOTE: This translation is for your information only. The legally binding document is the German version of these General Terms and Conditions (Allgemeine Geschäftsbedingungen).

1. Scope of Application

The following Terms and Conditions shall apply to all contracts regarding professional training programmes such as seminars, workshops, certificate courses, e-learning-offers and similar services rendered by the Erich Pommer Institut (hereinafter referred to as EPI) with the booking person. They also apply to our European workshop series ESSENTIAL LEGAL FRAMEWORK, the programmes AUDIOVISUAL WOMEN and SERIES' WOMEN.

Subsidiary agreements, alterations, amendments, or any other form of modification to this text must be in written form to become effective. The experts and speakers are not entitled to perform the aforementioned modifications to these General Terms and Conditions or the contract itself.

For the purchase of publications via the Erich Pommer Institute’s own website the sections 4., 9., 10, 11., 13.-16. apply respectively.

The nullity of any of the provisions herein shall affect neither the validity of the agreement as such nor the validity of these General Terms and Conditions. The legally void provision shall be replaced by the parties’ presumed agreement, which must be in accordance with sec. 306 par. 2 of the German Civil Code (BGB).

By registering/applying, the booking party agrees with the validity of these General Terms and Conditions.

2. Participation

a. Events without application procedure
In general, participation in EPI’s training events is open to the public. The allocation of the seats will be done on a first-come, first-served basis according to the date of registration. Exceptions will apply to training events that require an application procedure.

When registering for trainings within the ESSENTIAL LEGAL FRAMEWORK series, participants from member states of the MEDIA program shall be given priority over participants from non-member states.

b. Events with application procedure

When allocating seats for events with an application procedure the EPI does so in consultation with the respective partner of the event, if applicable.

i. Classes in cooperation with Filmuniversität

Applicants for Winterclass Serial Writing & Producing, Beyond Stereotypes and Virtual Production Lab are chosen by Filmuniversität and EPI.

ii. Women's Leadership Programmes EQUALead and sparkx

The women's leadership programme sparkx has a registration procedure.

The EQUALead programme has an application procedure.

When applying for EQUALead, the participants are selected by the EPI. When selecting participants for EQUALead, preference is given to companies that send two employees ("tandems") from middle to senior management to the programme. Attention will be paid to a balanced participation of the different media and cultural sub-sectors. Decoupled participation without a tandem partner is also possible. In this case, the participant contribution remains the same as for the secondment of two persons. Due to the funding regulations, the EQUALead programme is primarily aimed at small and medium-sized media and cultural enterprises in Berlin and in the so-called more developed regions in the old federal states according to the EU NUTS system. Large companies can also apply. Preference is given to SMEs.

iii. International Female Leadership programmes AUDIOVISUAL WOMEN and SERIES' WOMEN

When applying for the international Female Leadership Programs, priority will be given to participants from MEDIA Program Member States. Participants undertake to nominate, if possible, another person from the company/work environment who will participate in the HR module of the programs.

iv. Certificate Courses & Workshop Production Accounting

When applying for the certificate courses Filmproduction Management and Regieassistenz, the participants will be selected by EPI according to the respective requirements.

For the Production Accounting workshop, the participants are selected by EPI in consultation with the cooperation partners.

c. Exclusion from events

The EPI reserves the right to exclude participants from training events in case the participant is in breach of obligations provided in section 9 or does not meet his obligations to pay the participation fee in time.

3. Registration

a. Registration for training programmes (residential or online) without application procedure

Registration for training programmes without application process will take place on the website www.epi.media. By clicking on the button “book now” on the intended programme’s site, by entering the participant’s and the booking person’s personal data and by finally clicking on the button “complete your booking”, the booking person agrees to conclude a legal binding contract.

By registering, the participant and the booking person agree with the computerised processing and storing of their personal data. This agreement can be revoked at any time. The EPI reserves the right to distribute the contact details of any participant to the lecturers and other participants of the respective program unless the consent hereto has been revoked before in written form. The same applies to the distribution of the participants’ contact details to the sponsors if the respective programme is sponsored. b. Registration for training programmes (residential or online) with application procedure

The application for events with a preceding application procedure happens via an application form until the mentioned application deadline. After the expiration of the application deadline there is no claim on considering the application.

The allocation of the limited participant seats is made in accordance with section 2, no claim for a seat can be made.

Participant seats are offered by the EPI via e-mail. In the case of EQUALead with an attached declaration of acceptance. The offer of a seat is bound to a confirmation deadline, after which the claim for a seat in the respective programme expires.

The acceptance of a participant seat via e-mail or letter is binding and obligates the participant to pay the participation fee. The invoice created and sent via e-mail by the EPI serves as a booking confirmation.

c. Registration for e-learning courses

The registration process for the e-learning programmes will be handled by the contract partner Coursio whose General Terms and Conditions will be part of the EPI’s General Terms and Conditions. By ordering, the participant declares his or her consent thereto.

Each participant will receive a personal password-protected account. The usage of the provided e-learning software will be personally limited to this participant, to up to three terminal devices as well as to a pre-defined period of time. The latter will be determined by the respective programme. It is forbidden to provide a third party with the account data. In case of misuse, the EPI reserves the right to block the account and, if necessary, to raise damage claims. The participant is responsible for creating the technical conditions for the account, notably the necessary hardware and the operating system software on his or her device. The EPI will provide information regarding the optimal browser software upon request.

4. Conclusion of Contract, Fees & Payment

For events without an application procedure, the legally binding contract will be concluded by the booking party clicking on the button “complete your booking” and the EPI sending a booking confirmation letter via e-mail to the booking person thereafter. After the successful booking the booking party will receive a booking confirmation and an invoice via e-mail. An invoice via post-mail will only be sent upon explicit request.

For events with a preceding application procedure the conclusion of contract will take place via seat acceptance in due time by the applicant via e-mail or mail.

The participation fees apply per person and event.

They will be due upon receipt of the booking confirmation/invoice, without any further payment request needed.

The payment can be made via the following payment options:

Advance payment by bank transfer
Payment by credit card
Payment by PayPal
Payment by PayPal Express
Payment by immediate payment (Sofortüberweisung)

In case of choosing the payment option “advance payment by bank transfer”, the booking person will be provided with the bank details in addition to the booking confirmation letter. The invoiced amount must be transferred to the mentioned bank account within 14 days; in case of payment for events, this payment must be completed no later than fourteen days prior the beginning of the event (date of the incoming payment). The EPI reserves the right to exclude the participant from the event if the invoiced amount has not been payed until the beginning of the event.

In case of choosing the payment option “payment by credit card”, the credit card will be debited upon reception of the booking person’s order. In case of last-minute registrations at the event venue, the contract will be concluded by the participant’s signature and the consent of the EPI’s personal.

The purchased publications will be sent either by mail or by e-mail upon payment to the indicated EPI’s bank account. Shipping costs are included in the price.

5. Implementation of Events

To be implemented, every event requires a cost-covering number of participants. In case of fewer participation, the EPI reserves the right to cancel or to reschedule the event. Opportunity and consequential damages due to cancelation or postponement will only be reimbursed by the EPI in case of gross negligence or malice.

6. Programme Modification, Cancellation and Rescheduling of Seminars

The EPI reserves the right to find an adequate replacement, to postpone or to cancel the event if the announced expert or speaker cannot be present at the event. The participants will be informed immediately. Opportunity and consequential damages due to cancelation or postponement will only be reimbursed by the EPI in case of gross negligence or malice.

In the event of cancellation by the EPI, the participant shall be reimbursed in full for any participation fees already paid.

In the event of rescheduling, the participant shall have the right to withdraw from the contract within one week of notification in writing to the EPI by means of e-mail, fax or letter. If the participant does not avail oneself to this option, the registration of the participant will be considered legally binding regarding the newly scheduled event without any further confirmation from the EPI being necessary.

There is no right to withdraw from the seminar if the curriculum of the seminar is changed. This applies identically to the e-learning programmes. The EPI reserves the right to change, limit or exchange the curriculum of the courses as well as to modify the modules regarding their contents, notably to reduce or expand them.

7. Right of Withdrawal for Consumers

The person booking services on the EPI’s website – if he/she can be defined as a consumer according to sec. 13 of the German Civil Code (BGB) – has the right to withdraw from a booking within 14 days after reception of the booking confirmation free of charge and without any explanation. This withdrawal has to be made in written form via regular post, fax or e-mail.

In case of an effective withdrawal, the mutually received services/payments have to be returned including any used benefits (i.e. interest – if applicable). If a booking was withdrawn, all payments, which were received by EPI from the booking person including delivery costs (if applicable), will be re-transferred within 30 days after the reception of the withdrawal. For the re-transfer, EPI will use the same option of payment that had been used in the initial transaction unless otherwise arranged by both parties. No costs will be charged for the reimbursement.

The right of withdrawal expires if both parties explicitly consent on fulfilling the contract before the right of withdrawal was executed. If a service starts within the withdrawal period, the booking person has to pay an appropriate amount, that is in accordance with the already delivered portion of the agreed upon services.

The booking person is not defined as a consumer if the participation in events/e-learnings can be assigned predominantly with the person’s commercial and/or self-employed occupation.

8. Cancellation of Training Offers

The cancellation of booked and confirmed registrations has to be declared in written form (e-mail, fax or letter). Cancellations via telephone are ineffective.

Depending on the respective training programme, different time limits for cancellation are in place (see 8. a-d). The date of entry of the cancellation at the EPI is applicable. Already paid seminar fees will be reimbursed in full if cancellation is declared in time. In the event of delayed cancellation, a cancellation fee or full seminar fee is charged.

a. Cancellation of half- and full-day seminars (online and presence)

Cancellation of half- and full-day seminars can be declared free of charge until eight business days prior to the beginning of the seminar. If cancellation is declared later, the seminar fee is due in full. The same applies if the participant registers later than eight working days prior to the beginning of the seminar or if he or she does not attend the seminar at all. The participants have the right to find a suitable replacement without any further fees being charged. In this event, the personal data of the replacement must be sent to the EPI immediately.

b. Cancellation of multi-day training events (without application procedure)

Cancellation can be declared free of charge up until three weeks prior to the beginning of the event. After that, 100% of the participation fee will be due.

The participants have the right to find a suitable replacement without any further fees being charged.

c. Cancellation of multi-day training events (with application procedure)

The applicant’s acceptance of a participant seat via e-mail or letter is binding and obligates the participant to pay the participation fee. A Cancellation can be declared free of charge up until the following deadlines:

i. Series Women and Audiovisual Women as well as Classes in cooperation with Filmuniversity

A cancellation can be declared free of charge up until 4 weeks prior to the beginning of the event. If the cancellation is declared later or if the participant fails to attend the event without a prior cancellation, 100% of the participation fee will be due. The participants have the right to suggest a substitute participant without additional charges, pending an approval via EPI. EPI cannot refuse the approval if the suggested substitute person is suitable for the participation.

ii. Certificate Courses Filmproduction Management and Regieassistenz as well as Workshop Production Accounting and Women’s Leadership Programmes EQUALead and sparkx

A cancellation can be declared free of charge up until 2 weeks prior to the beginning of the event. If the cancellation is declared later or if the participant fails to attend the event without a prior cancellation, 100% of the participation fee will be due. The participants have the right to suggest a substitute participant without additional charges, pending an approval via EPI. EPI cannot refuse the approval if the suggested substitute person is suitable for the participation.

d. Cancellation of the media.think.tank conference

Cancellation can be declared until 10 days prior to the conference. A cancellation-fee of 10 € will be charged for each cancellation. If cancellation is declared later or in the event of non-participation without prior notification thereof, the participation fee will be due in full.

The participants have the right to appoint a suitable replacement without any further fees being charged. The replacement person has to be appointed to the EPI 48 hours prior to the conference.

9. Obligations of the Participants

The participant is obligated to comply with instructions by staff members of the EPI concerning rules of the house. The participant agrees to handle all provided devices and materials and the facilities and premises with care as well as to refrain from smoking in the premises, if not stated otherwise. In case EPI provides technical equipment, such as personal computers for the participants, these will only be used for the specific purpose of the training event. Any copying, installing, changing, down- or uploading as well as modifying software or other data is strictly forbidden.

10. Copyrights, Rights of Use and Work Results

a. Handouts/Material

The distributed documents and materials are protected by copyright. The reproduction, transfer or usage, be it commercial or other, of the documents and materials is permitted only with the explicit, prior and written consent of the EPI.

The commercial use of those work results created by or in participation with participants during a training seminar, regardless of being protected as a whole or in parts by copyright laws or not, is permitted only with prior and written consent of all parties involved. The EPI shall not be liable for any infringement of rights by the participants.

The exploiting parties are obliged to inform the EPI about all relevant stages of development of the respective projects. The latter does not apply conclusively for the start of shooting, participation in film festivals, export sales and cinema releases.

The EPI has the right to use advertising material (film stills, posters, film excerpts) in digital and physical form for its own advertising purposes in consultation with the evaluating parties.

The exploiting parties agree to refer to the respective initiating programme and the EPI during the exploitation in an appropriate way.

b. E-learning courses

Every provided content is protected by copyright. All rights resulting therefrom, notably storing and distributing – even in form of excerpts – are reserved for the EPI. The participants do not obtain any property right or right of use regarding the provided contents.

Within the limits of the license agreement and the following provisions the participant obtains a single, limited to the duration of the license agreement and non-transferable right to participate in the ordered e-learning programme. The right to participate consists of the right to access the contractual e-learning programme as well as the right to retrieve learning content for personal learning purposes. The retrieved documents can be used only by the purchaser and only during the time of use. All commercial transfer of the content or the documents is prohibited. The time of use of the e-learning license is limited to a period of time of tree month, if not stated otherwise in the service description, beginning with the conclusion of the contract.

c. Publications

All publications are protected by copyright. The reproduction, transfer or usage, be it commercial or other, of the publications as a whole or in part is permitted only with the explicit, prior and written consent of the EPI.

11. Certificate of Attendance

A certificate of attendance can be issued, if requested.

For the programme JAHRES UPDATE MEDIEN- UND URHEBERRECHT qualified certificates stating the content, training time and name of expert of the seminar will be issued. These certificates meet the requirements of sec. 15 of the German Specialist Lawyers Act (Fachanwaltsordnung, FAO).

Due to different practices among the bar associations the EPI cannot guarantee that the training offered will be accepted by every bar association.

12. Liability

The EPI takes no responsibility for the actuality, correctness and completeness regarding the provided materials or the implementation of the seminar.

The EPI bears liability for personal and property damages only in case of intent or gross negligence.

Regarding the e-learning programme the EPI bears responsibility for the suitability to utilization as stated in the contract. Insignificant constraints to the suitability will not be considered. The EPI will remedy deficiencies within an appropriate period of time.

The participant bears liability for all damages caused by actual fault.

13. Costs of Default

In the event of a payment default, EPI shall have the right to charge the amount of 3,00 Euro for each written warning to cover costs for postage and administrative purposes. During that time, no further participation in an EPI event is possible.

14. Newsletter Subscription

By registering for the EPI newsletter, the subscriber agrees that EPI will save and process his/her personal data in order to promote EPI’s training events via mail or/and e-mail. This newsletter service is free of charge. For receiving the electronic newsletter, the registrant needs to provide his/her e-mail address. Providing the postal address is considered to be a consent to also receive the print programmes via post mail.

15. Place of Jurisdiction and Place of Performance

German law shall apply. Place of jurisdiction and place of performance is Potsdam.

1. Anwendungsbereich

Diese Geschäftsbedingungen sind Bestandteil sämtlicher Verträge für die Teilnahme an Veranstaltungen, Fortbildungen, Seminaren, Workshops, E-Learning-Angeboten und ähnlichen Dienstleistungen der Erich Pommer Institut gGmbH (im Folgenden EPI) mit den Teilnehmerinnen und Teilnehmern (im Folgenden TN) bzw. der buchenden Person.

Sie gelten ebenfalls für die europäische Workshop-Reihe ESSENTIAL LEGAL FRAMEWORK und, das TRANS ATLANTIC PARTNERS-Programm und für das EUROPEAN TV DRAMA LAB 2012-2018.

Nebenabreden, Änderungen bzw. Ergänzungen bedürfen der Schriftform. Referent_innen sind nicht zur Abänderung der Kurs- und Vertragsbedingungen oder zur Abgabe von Zusagen berechtigt.

Für die Bestellung von Publikationen auf der Webseite der Erich Pommer Institut gGmbH gelten die Ziffern 4., 9., 10., 11., 13.-16. entsprechend.

Eine eventuelle Unwirksamkeit einzelner Bestimmungen lässt die Wirksamkeit der AGB als solche und der zugrunde liegenden Verträge unberührt. An die Stelle einer unwirksamen Bestimmung tritt die von den Parteien mutmaßlich gewollte, gesetzlich zulässige Regelung gemäß § 306 Abs. 2 BGB.
Mit der Bestellung/Bewerbung erklärt sich die Vertragspartei mit der Geltung dieser Allgemeinen Geschäftsbedingungen einverstanden.

2. Teilnahme

a. Veranstaltungen ohne Bewerbungsverfahren
Die Teilnahme an den Veranstaltungen des EPI steht grundsätzlich jeder Person offen. Die Zuteilung der begrenzten Seminarplätze erfolgt nach dem Datum der Anmeldung. Ausgenommen hiervon sind Veranstaltungen, denen ein Bewerbungsverfahren vorausgeht.

b. Veranstaltungen mit Bewerbungsverfahren
Bei der Vergabe von TN-Plätzen für Veranstaltungen mit Bewerbungsverfahren entscheidet das EPI ggf. in Absprache mit dem jeweiligen Partner der Veranstaltung auf Grund der Eignung des Bewerbers/der Bewerberin, wer teilnehmen darf.

i. Bei der Anmeldung für die Veranstaltungen des ESSENTIAL LEGAL FRAMEWORK-Programms werden TN aus den EU-Mitgliedsstaaten, bei der Auswahl der TN des TRANS ATLANTIC PARTNERS Programms werden kanadische und U.S. Amerikanische Staatsangehörige sowie TN aus den EU-Mitgliedstaaten vorrangig berücksichtigt.

ii. Classes in Kooperation mit der Filmuniversität
Bei der Bewerbung für die Winterclass Serial Writing & Producing, Sitcom-Class oder das Social Storytelling Lab werden die TN von Filmuniversität und EPI ausgewählt.

iii. Frauen-Leadership-Programme sparkx und shift|F
Bei der Bewerbung für die Frauen-Leadership-Programme sparkx und shift|F werden die TN vom EPI ausgewählt. Bei der Auswahl der TN für sparkx werden bevorzugt Unternehmen berücksichtigt, die zwei Mitarbeiter_innen („Tandems“) aus dem mittleren bis höheren Management in das Programm entsenden. Dabei wird auf eine ausgewogene Beteiligung der verschiedenen Medienunterbranchen geachtet. Die Programme sparkx und shift|F richten sich aufgrund der Förderbedingungen vornehmlich an kleine und mittlere Medienunternehmen in Berlin und in stärker entwickelten Regionen in den alten Bundesländern. Großunternehmen können sich auch bewerben. Bevorzugt werden KMU berücksichtigt.

c. Ausschluss von Veranstaltungen
Das EPI behält sich vor, TN von einer Teilnahme an Veranstaltungen auszuschließen, insbesondere dann, wenn diese gegen ihre Pflichten aus Ziff. 9 verstoßen bzw. die Seminargebühren nicht rechtzeitig bezahlt haben.

3. Anmeldung

a. Anmeldung für Präsenzveranstaltungen ohne Bewerbungsverfahren
Die Anmeldung für Angebote ohne Bewerbungsverfahren erfolgt auf der Website www.epi.media. Mit Anklicken des Buttons „Jetzt Buchen“ auf der Seite des gewünschten Programms und Eingabe der persönlichen Daten des/der TN sowie des/der buchenden Person und der anschließenden Bestätigung durch Betätigung des Buttons „Jetzt zahlungspflichtig buchen“ gilt die Anmeldung als rechtlich verbindlich.

Durch die Anmeldung wird das frei widerrufbare Einverständnis dazu erteilt, dass Ihre Daten EDV-gestützt verarbeitet und gespeichert werden dürfen. Das EPI behält sich vor, den TN sowie den Referent_innen einer Veranstaltung die Namens- und Kontaktdaten zugänglich zu machen, es sei denn die Zustimmung hierzu wurde ausdrücklich schriftlich widerrufen. Gleiches gilt für die Weitergabe der Namens- und Kontaktdaten der TN von geförderten Veranstaltungen an die jeweiligen Förderinstitutionen. Weitere Informationen zur Erhebung, Verarbeitung und Speicherung von personenbezogenen Daten sind in unseren Datenschutzbestimmungen einsehbar.

b. Anmeldung für Präsenzveranstaltungen mit Bewerbungsverfahren
Die Bewerbung für Veranstaltungen mit vorgeschaltetem Bewerbungsverfahren erfolgt über ein Bewerbungsformular bis zur genannten Bewerbungs-Deadline. Nach Ablauf der Bewerbungsdeadline besteht kein Anspruch auf Berücksichtigung der Bewerbung.
Die Vergabe der begrenzten TN-Plätze erfolgt gemäß Ziff. 2, ein Anspruch auf einen TN-Platz besteht nicht.
Das Angebot eines TN-Platzes durch das EPI erfolgt per E-Mail. Im Falle der Frauen-Leadership-Programme sparkx und shift|F mit beigefügter Annahmeerklärung. Das Angebot eines TN-Platzes ist an eine Rückmeldefrist gebunden, nach deren Ablauf der Anspruch auf Zulassung erlischt.
Die Annahme des TN-Platzes durch den/die TN per E-Mail oder Post ist verbindlich und verpflichtet den/die TN zur Zahlung der TN-Gebühr. Die durch das EPI erstellte und per E-Mail verschickte Rechnung gilt als Buchungsbestätigung.

c. Anmeldung E-Learning
Die Anmeldung zu den E-Learning-Angeboten wird über den Vertragspartner Coursio abgewickelt, dessen AGB Teil der AGB des EPI werden. Mit einer Bestellung erklärt sich der/die TN damit einverstanden.
Jede/r TN erhält von Coursio einen persönlichen passwortgeschützten Zugang. Die Nutzung der E-Learning-Software ist auf diese/n TN persönlich, auf drei Endgeräte und auf einen festgelegten Zeitraum begrenzt. Dieser bestimmt sich nach dem jeweiligen Angebot.
Eine Weitergabe der Zugangsdaten an Dritte ist nicht erlaubt. Bei Missbrauch ist das EPI berechtigt, den Zugang zu sperren und behält sich vor, Schadensersatzansprüche geltend zu machen.
Die TN sind dafür verantwortlich, bei sich die technischen Voraussetzungen für den Zugang zu dem E-Learning-Angebot zu schaffen, insbesondere hinsichtlich der eingesetzten Hardware und Betriebssystemsoftware. Das EPI wird den/die TN auf Anfrage über den jeweils einzusetzenden Browser informieren.

4. Vertragsabschluss, Kosten & Zahlung

Der rechtlich verbindliche Vertrag kommt bei Veranstaltungen ohne Bewerbungsverfahren durch Anklicken des Buttons „Jetzt zahlungspflichtig Buchen“ durch die buchende Person und den Versand der Buchungsbestätigung per E-Mail durch das EPI zustande. Nach der erfolgten Buchung erhält die/der Buchende eine Buchungsbestätigung und Rechnung per E-Mail. Eine Rechnung per Post erfolgt nur auf ausdrücklichen Wunsch.
Bei Veranstaltungen mit vorgeschaltetem Bewerbungsverfahren erfolgt der Vertragsschluss durch die fristgemäße Annahme des angebotenen TN-Platzes durch den/die Bewerber_in per E-Mail oder Post.

Die Seminargebühren verstehen sich pro Person und Veranstaltung.

Bei Auswahl der Zahlungsart Vorkasse erhalten Sie mit der Buchungsbestätigung unsere Bankverbindung. Der Rechnungsbetrag ist binnen 14 Tagen auf das angegebene Konto einzuzahlen; bei Veranstaltungen bis spätestens 14 Tage vor Beginn der Veranstaltung (Geldeingang). Bei nichtbezahlter Rechnung am Veranstaltungstag behält sich das EPI einen Ausschluss von der Veranstaltung vor.

Bei Zahlung per Kreditkarte erfolgt die Belastung Ihres Kreditkartenkontos mit dem Eingang Ihres Auftrages. Die Abrechnung der Webseite via Kreditkarte erfolgt durch:

In Fällen kurzfristiger Anmeldungen am Veranstaltungsort kommt der Vertrag mit der Unterschrift der/des TN und der Zustimmung des EPI-Personals zustande.

Der Versand der erworbenen Publikation erfolgt nach Eingang der Zahlung auf das angegebene Konto des EPI wahlweise per Post oder E-Mail. Versandkosten sind im Preis enthalten.

5. Durchführung

Eine Veranstaltung findet nur bei Erreichen einer kostendeckenden TN-Zahl statt. Bei Nichterreichen hat das EPI das Recht, die Veranstaltung abzusagen und ggf. auf einen späteren Termin zu verschieben. Die Erstattung von Ersatz- und Folgekosten für die TN wegen Ausfalls bzw. zeitlicher Verschiebung von Veranstaltungen ist ausgeschlossen, sofern nicht dem EPI Vorsatz oder grobe Fahrlässigkeit zur Last fällt.

6. Programmänderung, Absage und Verschiebung von Seminaren

Das EPI behält sich vor, im Fall der Verhinderung des/der Referent_innen einen adäquaten Ersatz zu stellen, die Veranstaltung zu verschieben bzw. vollständig abzusagen. Die TN werden hiervon unverzüglich in Kenntnis gesetzt. Die Erstattung von Ersatz- und Folgekosten für die TN wegen Ausfalls bzw. zeitlicher Verschiebung von Veranstaltungen ist ausgeschlossen, sofern nicht dem EPI Vorsatz oder grobe Fahrlässigkeit zur Last fällt.

Bei einer Absage der Veranstaltung von Seiten des EPI werden den TN bereits entrichtete Seminargebühren in voller Höhe erstattet.

Bei einer Verschiebung des Termins haben die TN das Recht, innerhalb von einer Woche nach Terminbekanntmachung durch schriftliche Mitteilung gegenüber dem EPI (per E-Mail, Fax oder Brief) von der Anmeldung zurück zu treten. Machen sie davon keinen Gebrauch, so wird ihr Schweigen als verbindliche Anmeldung für das Seminar zum neuen Termin gewertet, ohne dass es einer erneuten Bestätigung durch das EPI bedarf.

Inhaltliche Modifizierungen des Lehrplans von Seiten des EPI berechtigen nicht zum Rücktritt. Dies bezieht sich auch auf das E-Learning-Angebot. Das EPI ist berechtigt, die Inhalte der Kurse zu verändern, einzuschränken oder Inhalte auszutauschen sowie Module hinsichtlich ihrer Inhalte angemessen zu modifizieren, insbesondere diese zu reduzieren oder zu erweitern.

7. Widerrufsrecht für Verbraucher

Die buchende Person hat, sofern sie Verbraucher iSd § 13 BGB ist, das Recht, die Buchung innerhalb von 14 Tagen nach Erhalt der Anmeldebestätigung mittels einer eindeutigen Erklärung per Post, Fax oder E-Mail kostenfrei und ohne Begründung schriftlich zu widerrufen.

Zur Fristwahrung genügt die rechtzeitige Absendung des Widerrufs an folgende Adresse:

Im Falle eines wirksamen Widerrufs sind die beiderseits empfangenen Leistungen zurück zu gewähren und ggf. gezogene Nutzungen (z.B. Zinsen) herauszugeben. Wird eine Buchung widerrufen, werden alle Zahlungen, die das EPI von der buchenden Person erhalten hat, einschließlich der Lieferkosten unverzüglich und spätestens binnen 30 Tagen ab dem Tag zurückgezahlt, an dem die Mitteilung über den Widerruf dieses Vertrags beim EPI eingegangen ist. Für diese Rückzahlung verwendet das EPI dasselbe Zahlungsmittel, das bei der ursprünglichen Transaktion eingesetzt wurde, es sei denn, es wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden für diese Rückzahlung Entgelte berechnet.

Das Widerrufsrecht erlischt vorzeitig, wenn der Vertrag von beiden Seiten auf ausdrücklichen Wunsch der buchenden Person erfüllt ist, bevor das Widerrufsrecht ausgeübt wurde. Beginnt eine Dienstleistung während der Widerrufsfrist, so hat die buchende Person dem EPI einen angemessenen Betrag zu zahlen, der dem Anteil der bis zur Ausübung des Widerrufsrechts bereits erbrachten Dienstleistungen im Vergleich zum Gesamtumfang der im Vertrag vorgesehenen Dienstleistungen entspricht.

Keine Verbrauchereigenschaft und damit Widerrufsbefugnis liegt vor, wenn die Teilnahme an der Veranstaltung überwiegend der gewerblichen oder selbstständigen beruflichen Tätigkeit der/des TN zugeordnet werden kann.

8. Stornierung von Weiterbildungsangeboten

Die Stornierung gebuchter und bestätigter Anmeldungen ist grundsätzlich nur schriftlich (per E-Mail, Fax oder Brief) möglich. Telefonische Stornierungen sind unwirksam.
Es gibt je nach Weiterbildungsformat unterschiedliche Stornierungsfristen (siehe 8 a-c). Maßgeblich ist das Datum des Eingangs der Stornierung beim EPI. Bei Stornierung vor Ablauf der Frist werden bereits entrichtete Seminargebühren in vollem Umfang rückerstattet. Nach Ablauf der Frist ist eine kostenfreie Stornierung nicht mehr möglich.

a. Stornierung halb-/ganztägiger Seminare
Stornierungen von halb-/ganztägigen Seminaren der nationalen Weiterbildung sind bis zu sechs Werktage vor dem Veranstaltungstag kostenfrei möglich.
Nach Ablauf dieser Frist werden die Seminargebühren in vollem Umfang fällig. Gleiches gilt, wenn die Anmeldung weniger als sechs Werktage vor dem Veranstaltungstermin erfolgt und auch bei Nichtteilnahme. Den TN wird das Recht eingeräumt, ohne zusätzliche Kosten eine/n Ersatz-TN zu stellen. In diesem Fall müssen die Daten dem EPI unverzüglich bekannt gegeben werden.

b. Stornierung mehrtägiger Weiterbildungsveranstaltungen (ohne Bewerbungsverfahren)
Eine kostenfreie Stornierung ist bis zu drei Wochen vor der Veranstaltung möglich. Danach werden 100% der Seminargebühren fällig.
Den TN wird das Recht eingeräumt, ohne zusätzliche Kosten eine/n Ersatz-TN zu benennen.

c. Stornierung mehrtägiger Weiterbildungsveranstaltungen (mit Bewerbungsverfahren)
Eine kostenfreie Stornierung ist bis zu acht Wochen vor der Veranstaltung möglich. Bei einer späteren Stornierung oder bei Nichtteilnahme ohne vorherige Absage werden die Seminargebühren in voller Höhe fällig. Den TN wird das Recht eingeräumt, ohne zusätzliche Kosten eine/n Ersatz-TN zu benennen, der/die einer Genehmigung von Seiten des EPI bedarf. Das EPI darf die Genehmigung nicht versagen, sofern die Ersatzperson zur Teilnahme geeignet ist.

d. Stornierung Kongress media.think.tank
Eine Stornierung der Anmeldung zum Kongress media.think.tank ist bis 10 Werktage vor dem Veranstaltungstag möglich. In diesem Fall wird eine Bearbeitungsgebühr in Höhe von 8,50 € für jede Anmeldung fällig.
Nach Ablauf dieser Frist werden die Anmeldegebühren in vollem Umfang fällig. Gleiches gilt, wenn die Anmeldung weniger als 10 Werktage vor dem Veranstaltungstermin erfolgt und auch bei Nichtteilnahme. Den TN wird das Recht eingeräumt, ohne zusätzliche Kosten eine/n Ersatz-TN zu stellen. In diesem Fall müssen die Daten dem EPI bis spätestens einen Tag vor Kongressbeginn bekannt gegeben werden.

9. Pflichten der TN

Die TN verpflichten sich zu einem respektvollen Umgang und zur Einhaltung der Hausordnung in den vom EPI angemieteten Räumen. Sie erklären sich damit einverstanden, die Räumlichkeiten pfleglich zu behandeln und das Rauchen zu unterlassen, soweit es nicht ausdrücklich gestattet ist. Sofern technische Geräte von Seiten des EPI zur Verfügung gestellt werden, sind die TN nur zu der für die Veranstaltung bestimmten Nutzung befugt. Jegliches Kopieren, Installieren, Verändern, Down- oder Uploaden von Software und sonstigen Daten ist den TN ausnahmslos untersagt.

10. Urheberrechte, Nutzungsrechte und Arbeitsergebnisse

a. Präsenzveranstaltungen
Die zur Verfügung gestellten Unterlagen sind urheberrechtlich geschützt. Die Vervielfältigung, Weitergabe, gewerbliche oder anderweitige Nutzung der Unterlagen ist nur mit ausdrücklicher vorheriger schriftlicher Zustimmung des EPI gestattet.

Jede gewerbliche Verwertung von Arbeitsergebnissen, die von oder unter Mitwirkung der TN im Rahmen einer Fortbildungsveranstaltung geschaffen wurden, bedarf ungeachtet des Umstandes, ob sie urheberrechtlich geschützte Werke sind oder solche beinhalten, der vorherigen schriftlichen Zustimmung aller beteiligten Personen. Das EPI haftet nicht für eine Rechtsverletzung durch die TN.

Die auswertenden Parteien verpflichten sich, das EPI über wesentliche Entwicklungsstadien des Projekts zu informieren. Dies gilt beispielsweise aber nicht abschließend für den Drehbeginn, Festival-Teilnahmen, Auslandsverkäufe und Kino-Start.

Das EPI darf Werbematerial des Projekts (Filmstills, Poster, Ausschnitte des Films) in digitaler und physischer Form in Absprache mit den auswertenden Parteien für eigene Werbezwecke digital und analog nutzen.

Die auswertenden Parteien verpflichten sich, bei der Auswertung in angemessener Weise auf das jeweilige initiierende Programm und das Erich Pommer Institut hinzuweisen. Bei der Verwertung eines Projekts,

aa. das im TAP Programm entwickelt wurde, verpflichten sich die verwertenden Parteien zur Nennung des Programms und zur Abbildung des TAP-Logos im Abspann des fertig gestellten Films wie folgt: „With the support from TRANS ATLANTIC PARTNERS“ in the „thanks/special thanks“ section (or similar).

bb. das im EUROPEAN TV DRAMA (SERIES) LAB entwickelt wurde, verpflichten sich die Parteien zur Nennung des Programms und des Veranstalters wie folgt: „Idea generated/created at EUROPEAN TV DRAMA (SERIES) LAB 201X by Erich Pommer Institut in association with MediaXchange“

b. E-Learning
Alle bereitgestellten Inhalte sind urheberrechtlich geschützt.
Die dadurch begründeten Rechte, insbesondere die Speicherung und Verbreitung – auch auszugsweise – sind dem EPI vorbehalten. Die TN erhalten keinerlei Eigentums- oder Verwertungsrechte an den bereitgestellten Inhalten.

TN erhalten im Rahmen des Nutzungsvertrages sowie der nachfolgenden Bestimmungen ein einfaches, auf die Dauer des Nutzungsvertrages befristetes, auf Dritte nicht übertragbares Recht zur Teilnahme an dem bestellten E-Learning-Angebot.

Das Teilnahmerecht während der Vertragsdauer umfasst den Zugang zum vertragsgegenständlichen E-Learning-Angebot sowie die Berechtigung zum Abrufen von Lerninhalten zu eigenen Lernzwecken.
Die abgerufenen Dokumente dürfen nur für den eigenen Gebrauch der Bestellerin/des Bestellers während der Nutzungszeit verwendet werden. Jede gewerbliche Weitergabe der Inhalte oder Dokumente ist unzulässig.
Die Nutzung der E-Learning-Kurslizenz ist auf einen Zeitraum von 3 Monaten ab Vertragsbeginn begrenzt, soweit nicht in der Leistungsbeschreibung eine abweichende Dauer festgelegt ist.

c. Publikationen
Alle Publikationen sind urheberrechtlich geschützt.
Die Vervielfältigung, Weitergabe, gewerbliche oder anderweitige Nutzung der Publikationen in Ihrer Gesamtheit oder in Auszügen ist nur mit ausdrücklicher vorheriger schriftlicher Zustimmung des EPI gestattet.

11. Teilnahmebescheinigung

Auf Wunsch werden Teilnahmebescheinigungen ausgestellt.
Für das Programm EPI UPDATE MEDIENRECHT werden qualifizierte Bescheinigungen ausgestellt, die Inhalt, Schulungszeit und Referent_innen des Seminars enthalten und die formellen Anforderungen des § 15 FAO erfüllen.

Das EPI kann aufgrund der unterschiedlichen Praxis der einzelnen Rechtsanwaltskammern keine Haftung dafür übernehmen, dass die Fortbildung von jeder Rechtsanwaltskammer anerkannt wird.

12. Haftung

Das EPI übernimmt keine Haftung für die Aktualität, inhaltliche Richtigkeit und Vollständigkeit in Bezug auf die verwendeten Unterlagen und die Durchführung der Veranstaltung.

Das EPI haftet für Personen- oder Sachschäden nur bei vorsätzlicher oder grob fahrlässiger Verletzung der vertraglichen Pflichten.

Bezüglich des E-Learning-Angebots verantwortet das EPI die Tauglichkeit zum vertragsgemäßen Gebrauch. Eine unerhebliche Einschränkung der Tauglichkeit bleibt außer Betracht. Das EPI behebt Mängel innerhalb einer angemessenen Frist.

Die TN haften selbst für Schäden, die durch eigenes Verschulden entstanden sind.

13. Verzug

Bei Zahlungsverzug seitens der buchenden Person wird für jede außergerichtliche schriftliche Mahnung ein Betrag iHv. 3,-€ zur Abdeckung der Porto- und Versandkosten erhoben. Während des Verzugs ist eine Teilnahme an weiteren Veranstaltungen des EPI ausgeschlossen.

14. Newsletter-Bestellung

Mit der Registrierung für den EPI-Newsletter erklärt sich der/die Anmeldende damit einverstanden, dass das Erich Pommer Institut die personenbezogenen Daten speichern, verarbeiten und nutzen darf, um kostenlos Information zu Seminarangeboten und Veranstaltungen per Post und/oder Email zu verschicken. Für die Bestellung des Newsletters ist lediglich die Angabe der Email-Adresse erforderlich. Bei Angabe der Adressdaten und Auswahl der Option „Postalischer Versand von Programmangeboten“ gilt das Einverständnis auch für den postalischen Versand von Programmankündigungen als erteilt.
